• NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. To register for the Sweepstakes, entrants will be required to submit their first and last name, home address (no P.O. Boxes), city, state, zip code, home phone number with area code, date of birth and e-mail address. Although entrants are asked to select their Grand Prize destination upon entry, the potential winner may choose any one (1) of the four (4) prize destination locations described in these rules upon verification of winner's eligibility. All entries must be received by 11:59:59 a.m. ET on 7/15/10. Limit one (1) entry per person/e-mail address, per Day during the Promotional Period. A "Day" is defined as the 24-hour period beginning at 12:00:01 a.m. ET on any individual calendar date during the Promotional Period and ending at 11:59:59 p.m. ET on that date; except on March 5, 2010, when the hours will be from 12:00:01 p.m. ET through 11:59:59 p.m. ET and on July 15, 2010 when the hours will be from 12:00:01 a.m. ET through 11:59:59 a.m. ET. Each person may only use one (1) e-mail address to participate in this promotion, and such e-mail address may only be used by one person regardless of whether the e-mail address is shared by two or more people. Any participant who uses more than one (1) e-mail address to enter this promotion may be disqualified and any prizes won may be forfeited subject to Sponsor's sole discretion. In the event of a dispute as to the identity of an entrant, the authorized account holder of the e-mail address used to enter will be deemed to be the entrant. The "authorized account holder" is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder, as well as any other proof of eligibility that Sponsor may request. • ONE (1) GRAND PRIZE/ODDS: One (1) Grand Prize will be awarded, consisting of a 4-day/3-night trip package for Grand Prize winner and one (1) guest to winner's choice of one (1) of the following four (4) destinations (each a "Package"): 1) South Beach/Miami, FL; 2) Cancun, Mexico; 3) Paradise Island, Bahamas; or 4) Las Vegas, NV. Each Package includes: (i) round-trip coach air transportation for winner and his/her guest from the major airport nearest winner's primary residence (as determined by Sponsor) (If winner resides within 200 miles of destination chosen, ground transportation will be provided in lieu of air transportation. No cash or other compensation will be awarded for the difference in value between air transportation and ground transportation.); (ii) airport/hotel transfers; (iii) three (3) night hotel accommodations (standard room, double-occupancy; hotel to be chosen by Sponsor); (iv) one (1) spa service for winner and guest (subject to availability); (v) one (1) Hawaiian Tropic Gift Basket for Grand Prize winner containing items of Sponsor's choice; and (vi) $1,000 in spending money to be awarded in the form of a check made payable to the Grand Prize winner. Package must be taken within one (1) year of winner verification or prize will be forfeited in its entirety. Prize Package must be booked through Sponsor's designated agent and at least 6-8 weeks in advance of departure. While no part of this prize includes alcoholic beverages, alcoholic beverages may otherwise be available. Blackout dates apply. Specific travel dates and arrangements are subject to availability. Grand Prize winner and guest must travel on the same itinerary. Grand Prize winner and his/her guest are responsible for securing any and all required documentation for travel within or outside the 50 United States, including, but not limited to, a valid passport (if applicable). Guest of Grand Prize winner must be 18 years of age or older (19 or older if a resident of AL or NE; 21 or older if resident of MS). All other expenses, including, but not limited to, gratuities, sightseeing excursions, entertainment, parking, meals and additional transportation, not specified herein as included in the Package, are the responsibility of Grand Prize winner and his/her guest. Sponsor is not responsible for weather conditions, flight delays or cancellations due to circumstances beyond Sponsor's control, inability of Grand Prize winner or guest to use the Package or related benefits in accordance with applicable rules and restrictions, and/or any other difficulties occurring during or in connection with the Package or related activities. TOTAL APPROXIMATE RETAIL VALUE OF GRAND PRIZE: $4,700.00 USD (actual retail value of prize may vary depending upon the city of departure and destination selected by Grand Prize winner). Should the actual retail value be less than the stated approximate retail value, the difference will not be awarded in cash or in any other form. All income taxes on the prize are the sole responsibility of the Grand Prize winner. The Grand Prize winner will be issued an IRS Form 1099 for the value of the prize; a copy will be furnished to the IRS. No substitution, cash alternative, or transfer of prize is permitted, except at the sole discretion of the Sponsor or as provided herein. • DRAWING: A random drawing to select the Grand Prize winner from among all eligible entries received will be held on or about 7/28/10 by an independent judging organization. The potential Grand Prize winner will be notified by mail (Federal Express or other traceable mail) street address listed on his/her entry. If the prize notification is returned as undeliverable, or if the potential winner is disqualified for any reason, Sponsor will select an alternate potential winner in a random drawing from the remaining eligible entries received.
• ELIGIBILITY: To participate in the Sweepstakes, you must be a legal U.S. resident currently living in the 50 United States or DC, 18 years of age or older (19 or older if a resident of AL or NE; 21 or older if resident of MS) and have Internet access as of 3/5/10. Void outside the 50 United States and DC and where prohibited. Employees, officers and directors of the Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and members of the immediate families (defined for these purposes as including spouse, biological, adoptive and stepparents, children, siblings, grandparents and grandchildren, and the respective spouses of any of the foregoing, regardless of where they reside) or households (whether related or not) are NOT eligible to participate.
• OTHER CONDITIONS: Prize Package is nontransferable, non-assignable and may not be redeemed for cash or otherwise substituted except as provided herein. Sponsor reserves the right to substitute a prize or part thereof with cash or another prize or part thereof of equal or greater value, in Sponsor's sole discretion, in the event any advertised prize or part thereof becomes unavailable for any reason. Sponsor is not responsible for inability of winner to accept prize in accordance with these full Official Rules. Grand Prize winner will be required to complete an Affidavit of Eligibility and Publicity/Liability Release (where permitted) and Travel Release. Guest of Grand Prize winner is required to complete a Travel Release. All required documents must be returned within seven (7) days of receipt or the prizewinner will be disqualified and an alternate winner may be randomly selected from among the remaining eligible entries received, if feasible in Sponsor's opinion. By accepting the prize in this Sweepstakes, winner consents to the use of winner's name, photographs, biographical information, voice recordings and likenesses for advertising or publicity purposes by Sponsor in commerce and in any media worldwide, without limitation and without additional compensation, notice or permission, where permitted by law.
• RELEASE OF LIABILITY: By entering, all entrants agree to release and hold harmless Sponsor, and Sponsor's parent company, affiliates, subsidiaries, and the officers, directors, agents and employees of each of the foregoing, and all others associated with the development and execution of this Sweepstakes (collectively, the "Released Parties"), from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Sweepstakes and/or the acceptance, possession or use of the prize or portion thereof that may be awarded to them, including, but not limited to, liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting the prize, Grand Prize winner acknowledges and agrees that the Sponsor, and Sponsor's parent company, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or any portion thereof, including without limitation, its quality, mechanical condition or fitness for a particular purpose.
• MISCELLANEOUS: Neither Energizer Personal Care, LLC., ("Sponsor") nor its agents are responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, undelivered, inaccurate or not received by Sponsor for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; or (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to entrant's or any person's computer and/or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes. All incomplete or otherwise nonconforming entries will be disqualified. Sponsor and its agents are further not responsible for: (i) incorrect or inaccurate entry or prize claim information whether caused by entrant or by any of the equipment or programming associated with or utilized in the Sweepstakes, or for any other errors of any kind, whether technical, network, printing, typographical, human or otherwise, in any Sweepstakes-related materials or in the announcement of prize/prizewinner; or (ii) misrepresentation, cheating or fraud by any entrant. If any of the foregoing malfunctions, errors, defects or acts render the Sweepstakes incapable of operating as planned, Sponsor, at its sole discretion, may suspend or terminate this Sweepstakes immediately and select the winner in a random drawing from all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor, or in any other manner deemed fair and equitable by Sponsor. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged except as provided herein. Any attempts by an individual to access the site via a bot script or other brute-force attack will result in that individual's e-mail address becoming ineligible, and the entry/entries submitted by that e-mail address becoming void. If Sponsor, in its sole discretion, determines that an individual is tampering or attempting to tamper with the Sweepstakes or Web Site, such individual will be disqualified. Sponsor reserves the right to suspend or terminate this Sweepstakes without notice if, in Sponsor's sole discretion, the Sweepstakes becomes infected or otherwise corrupted or if the Sweepstakes otherwise cannot operate as planned; in such event, Sponsor will select winner in a random drawing from among all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor, or in any other manner deemed fair and equitable by Sponsor. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
