Full Official Rules

• NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. SWEEPSTAKES SUBJECT TO ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. MUST BE A LEGAL RESIDENT OF AND CURRENTLY LIVING IN THE 50 UNITED STATES or DC, EIGHTEEN (18) YEARS OF AGE OR OLDER (NINETEEN (19) OR OLDER IF A RESIDENT OF AL or NE; TWENTY-ONE (21) OR OLDER IF RESIDENT OF MS) AND HAVE INTERNET ACCESS AS OF 3/1/11. VOID OUTSIDE THE 50 UNITED STATES AND DC AND WHERE PROHIBITED. The Sweepstakes starts at 12:00:01 p.m. ET on 3/1/11 and ends at 11:59:59 a.m. ET on 8/15/11 (“Promotional Period”). To enter: visit www.hawaiiantropic.com/sweepstakes (“Web Site”) and follow the instructions posted on screen to complete and submit an entry. To register for the Sweepstakes, entrants will be required to submit their first and last name, home address (no P.O. Boxes), city, state, zip code, home phone number with area code, date of birth and e-mail address. All entries must be received by 11:59:59 a.m. ET on 8/15/11. Limit one (1) entry per person/e-mail address, per Day during the Promotional Period. A “Day” is defined as the 24-hour period beginning at 12:00:01 a.m. ET on any individual calendar date during the Promotional Period and ending at 11:59:59 p.m. ET on that date; except on 3/1/11, when the hours will be from 12:00:01 p.m. ET through 11:59:59 p.m. ET and on 8/15/11 when the hours will be from 12:00:01 a.m. ET through 11:59:59 a.m. ET. Each person may only use one (1) e-mail address to participate in this promotion, and such e-mail address may only be used by one person regardless of whether the e-mail address is shared by two or more people. Any participant who uses more than one (1) e-mail address to enter this promotion may be disqualified and any prizes won may be forfeited subject to Energizer Personal Care, LLC.’s (“Sponsor”) sole discretion. In the event of a dispute as to the identity of an entrant, the Authorized Account Holder of the e-mail address used to enter will be deemed to be the entrant. The “Authorized Account Holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. A potential winner may be required to show proof of being the Authorized Account Holder, as well as any other proof of eligibility that Sponsor may request. The Web Site may be available for eligible participants to enter this Sweepstakes while attending a Hawaiian Tropic “Share Your Shimmer” event. Visit the Web Site for event details and locations.
  
  Sponsor reserves the right to alter, suspend or terminate the sweepstakes without notice if, in sponsor’s absolute discretion, the Web Site or Sweepstakes security becomes compromised in any way. In the event sponsor does so, sponsor will post notice thereof on the Web Site. In the event the Sweepstakes is terminated prematurely and subject to the limits established in these Official Rules, Sponsor will conduct a drawing from among all eligible entries received prior to termination. Sponsor is not responsible for transmission defaults, computer server failure and/or delayed, garbled or corrupted data transmitted by entrants. Sponsor is not responsible for printing or typographical errors in any Sweepstakes-related materials. By entering this Sweepstakes, entrants or parents/legal guardians of entrants who are considered a minor in jurisdiction of residence, agree to be bound by these Official Rules and the decisions of the independent judging agency (“judges”), which will be final, binding and conclusive on all matters relating to this Sweepstakes. Any information collected by registering to enter the Sweepstakes will be used only in a manner consistent with and required by these Official Rules. All entries are the property of Sponsor and will not be returned or acknowledged. All Sweepstakes entries must be completed by 11:59:59 a.m. ET on 8/15/2011.
• PRIZES/ODDS:
  GRAND PRIZE (1): One (1) Grand Prize will be awarded, consisting of a 5-day/4-night Beaches Resorts Vacation for Grand Prize winner and one (1) guest (“Package”). Package includes (i) round-trip coach air transportation for winner and his/her guest from the major airport nearest winner’s primary residence (as determined by Sponsor); (ii) four (4) night’s resort accommodations (double-occupancy as selected by Sponsor) at any of the following Beaches Resorts: Beaches Turks & Caicos Resort Villages & Spa (Providenciales, Turks & Caicos), Beaches Negril Resort & Spa (Negril, Jamaica), Beaches Sandy Bay (Negril, Jamaica), or Beaches Boscobel Resort & Golf Club (Ocho Rios, Jamaica); (iii) food & beverages (excluding specialty dining); (iv) transfers between airport and resort; (v) standard resort amenities and activities; and (vi) $500 in spending money to be awarded in the form of a check made payable to the Grand Prize winner. Grand Prize winner will have the option of selecting the Beaches Friends Forever (“B.F.F.”) Getaway Package at Beaches Turks & Caicos Resort Villages & Spa provided winner can travel between 10/13/11 - 10/17/11 or 5/12/12 - 5/16/12. The B.F.F. Getaway Package includes several additional amenities, including a $200 Red Lane® Spa voucher, a discount voucher to Beaches’ specialty gift shop, a free photo and other items subject to Beaches Resorts discretion. The B.F.F. Getaway Package must be taken from 10/13/11 - 10/17/11 or 5/12/12 - 5/16/12. If Grand Prize winner is unable to travel on the dates specified for the B.F.F. Getaway, prizewinner will forfeit the added amenities associated with the B.F.F. Getaway Package.
  
  Trip must be taken by 9/1/12 or prize will be forfeited in its entirety. Package must be booked at least 8 weeks in advance of departure with the exception of the B.F.F. Getaway. Blackout dates may apply. Specific travel dates and arrangements are subject to availability. Grand Prize winner and guest must travel on the same itinerary. Grand Prize winner and his/her guest are responsible for securing any and all required documentation for travel outside the 50 United States, including, but not limited to, a valid passport (if applicable). Guest of Grand Prize winner must be 18 years of age or older (19 or older if a resident of AL or NE; 21 or older if resident of MS). All other expenses, including, but not limited to, gratuities, parking, additional transportation (including inter-island transportation), telephone calls, Red Lane® Spa treatments and services, specialty dining, tours and excursions, SCUBA certification courses, island departure taxes and purchases made at Beaches Specialty Shops, not specified herein as included in the Package, are the responsibility of Grand Prize winner and his/her guest. Sponsor is not responsible for weather conditions, flight delays or cancellations due to circumstances beyond Sponsor’s control, inability of Grand Prize winner or guest to use the Package or related benefits in accordance with applicable rules and restrictions, and/or any other difficulties occurring during or in connection with the Package or related activities. All aspects of the Grand Prize Package are provided by Sponsor with the exception of the four (4) night Beaches Resorts accommodations, which are provided by Unique Vacations, Inc., worldwide marketing and sales representatives for Beaches Resorts. APPROXIMATE RETAIL VALUE (“ARV”) OF GRAND PRIZE: Five Thousand Two Hundred Dollars ($5,200.00 USD) (actual retail value of prize may vary depending upon at least the city of departure and travel option selected). Should the actual retail value be less than the stated approximate retail value, the difference will not be awarded in cash or in any other form.
  
  FIRST PRIZES (10): Ten (10) First Prizes will be awarded, each consisting of a Hawaiian Tropic Gift Basket containing Hawaiian Tropic products and a Hawaiian Tropic-branded bathrobe. ARV OF EACH FIRST PRIZE: One Hundred Dollars ($100.00 USD). Total ARV OF ALL FIRST PRIZES: One Thousand Dollars ($1,000.00 USD).
  
  TOTAL ARV OF ALL PRIZES: Six Thousand Two Hundred Dollars ($6,200.00 USD). All income taxes on prizes are the sole responsibility of the winners. The Grand Prize winner will be issued an IRS Form 1099 for the value of the prize; a copy will be furnished to the IRS. No substitution, cash alternative, or transfer of prizes is permitted, except at the sole discretion of the Sponsor or as provided herein. All prizes will be awarded if the number of eligible entries received during the Promotional Period is equal to or greater than the number of prizes available. Please allow 6-8 weeks for delivery of prizes following verification. ODDS: Odds of winning depend on the number of eligible entries received. Limit: one (1) prize per person, household or address.
• DRAWING: A random drawing to select the Grand Prize and First Prize winners from among all eligible entries received will be held on or about 8/22/11 by an independent judging organization. Potential prizewinners will be notified by mail at the street address listed on his/her entry. Grand Prize winner will be required to complete an Affidavit of Eligibility and Publicity/Liability Release (where permitted) and Travel Release. Guest of Grand Prize winner is required to complete a Travel Release. If such documents are not returned within seven (7) days, or if prize notification is returned as undeliverable, or a potential winner is not in compliance with these rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner will be selected if feasible. If a potential winner is an eligible minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. Sponsor is not responsible for inability of any winner to accept a prize in accordance with these full Official Rules. Return of any prize as undeliverable will result in disqualification. If the prize or prize notification is returned as undeliverable, or if a potential winner is disqualified for any reason, Sponsor will select an alternate potential winner in a random drawing from the remaining eligible entries received, if feasible.
• ELIGIBILITY: To participate in the Sweepstakes, you must be a legal U.S. resident currently living in the 50 United States or DC, 18 years of age or older (19 or older if a resident of AL or NE; 21 or older if resident of MS) and have Internet access as of 3/1/11. Void outside the 50 United States and DC and where prohibited. Employees, officers and directors of the Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and members of the immediate families (defined for these purposes as including spouse, biological, adoptive and stepparents, children, siblings, grandparents and grandchildren, and the respective spouses of any of the foregoing, regardless of where they reside) or households (whether related or not) are NOT eligible to participate.
• OTHER CONDITIONS: Prizes are nontransferable, non-assignable and may not be redeemed for cash or otherwise substituted except as provided herein. Sponsor reserves the right to substitute a prize or part thereof with cash or another prize or part thereof of equal or greater value, in Sponsor’s sole discretion, in the event any advertised prize or part thereof becomes unavailable for any reason. By accepting a prize in this Sweepstakes, winners consent to the use of their names, photographs, biographical information, voice recordings and likenesses for advertising or publicity purposes by Sponsor in commerce and in any media worldwide, without limitation and without additional compensation, notice or permission, where permitted by law.
• RELEASE OF LIABILITY: By entering, all entrants agree to release and hold harmless Sponsor, Unique Vacations, Inc., worldwide marketing and sales representatives for Beaches Resorts, and each of their parent companies, affiliates, subsidiaries, and the officers, directors, agents and employees of each of the foregoing, and all others associated with the development and execution of this Sweepstakes (collectively, the “Released Parties”), from and against any and all liability with respect to, or in any way arising from or in connection with, participation in this Sweepstakes and/or the acceptance, possession or use of the prize or portion thereof that may be awarded to them, including, but not limited to, liability for personal injury, bodily injury, death, damages or loss of any kind. By accepting a prize, prizewinners acknowledge and agree that the Sponsor, and Sponsor’s parent company, affiliates, subsidiaries, and the officers, directors, agents, employees of each of the foregoing, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or any portion thereof, including without limitation, its quality, mechanical condition or fitness for a particular purpose.
• MISCELLANEOUS: Neither Sponsor nor its agents are responsible for: (i) electronic transmissions or entries that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected, undelivered, inaccurate or not received by Sponsor for any reason; (ii) any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures or human error that may occur in the transmission, receipt or processing of entries; (iii) destruction of or unauthorized access to, or alteration of, entries; or (iv) failed or unavailable hardware, network, software or telephone transmissions, damage to entrant’s or any person’s computer and/or its contents, or any other causes that jeopardize the administration, security, fairness, integrity or proper conduct of this Sweepstakes. All incomplete or otherwise nonconforming entries will be disqualified. Sponsor and its agents are further not responsible for: (i) incorrect or inaccurate entry or prize claim information whether caused by entrant or by any of the equipment or programming associated with or utilized in the Sweepstakes, or for any other errors of any kind, whether technical, network, printing, typographical, human or otherwise, in any Sweepstakes-related materials or in the announcement of prizes/prizewinners; or (ii) misrepresentation, cheating or fraud by any entrant. If any of the foregoing malfunctions, errors, defects or acts render the Sweepstakes incapable of operating as planned, Sponsor, at its sole discretion, may alter, suspend or terminate this Sweepstakes immediately and select the winners in a random drawing from all eligible entries received prior to and/or after (as appropriate) the action taken by Sponsor, or in any other manner deemed fair and equitable by Sponsor. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged except as provided herein. Any use of micro, automatic, programmed, robotic, or like entry methods will void all such entries by such methods, and entrants using such methods will be disqualified. Sponsor may prohibit an entrant from participating in the Sweepstakes if it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception or other unfair playing practices or intending to abuse, threaten or harass other entrants. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If Sponsor, in its sole discretion, determines that an individual is tampering or attempting to tamper with the Sweepstakes or Web Site, such individual will be disqualified. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. By entering this Sweepstakes, entrants agree to be bound by these full Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters relating to this Sweepstakes.
